1. INTRODUCTION

These warranty provisions govern the terms, conditions and limitations of warranty coverage for AureusDrive vehicles sold or serviced by AureusDrive or authorized partners. This warranty covers all mechanical and electrical components of the vehicles, unless otherwise specified. The warranty is excluded to the extent permitted by law.

AureusDrive undertakes to rectify the defects free of charge during the warranty period either by repairing the product, supplying a replacement product in exchange or refunding the purchase price against return of the product. Further warranty claims such as rescission (rescission of the purchase contract due to defects in the purchased item) and reduction are excluded.

The buyer is not entitled to choose one of these options, the choice is exclusively up to AureusDrive.
Warranty claims and their verification can only be asserted in an AureusDrive workshop or at an authorized AureusDrive partner (listed as an AureusDrive service partner on the official website) upon presentation of the original invoice, the original delivery bill or the warranty booklet and the defective product. A return is not possible.

The guarantee begins on the day of delivery or collection of a product. AureusDrive guarantees 5 years on frame damage and 2 years on all other components.
The guarantee only covers material and processing defects that were already present at the time of delivery. Any damage caused by external influences is excluded from the warranty, for example wear and tear.

In the event of a warranty claim, the cost of collection and shipping (if required) must be borne by the owner of the vehicle, otherwise the customer can hand the vehicle over to an AureusDrive workshop or an authorized AureusDrive partner for repair at any time free of charge.

2 SCOPE OF APPLICATION

This warranty applies exclusively to vehicles manufactured or distributed by AureusDrive and purchased within the specified warranty period.

The buyer is obliged to report the defect to an AureusDrive workshop or an authorized AureusDrive partner within 14 days of discovering it, otherwise the warranty claim will be forfeited.

If a product is replaced by a new product within the warranty period, the warranty period does not start again. The original delivery date of the vehicle is decisive.

The warranty claim covers all manufacturing and material defects, but not damage resulting from improper handling (operating errors) or damage caused by the purchaser or third parties or by intervention by unauthorized persons.

Furthermore, the warranty claim shall lapse if the damage was caused by use of the vehicle not in accordance with the rules of the road traffic regulations, if the vehicle is used in competitions of any kind, sports demonstrations, performances, tests and trials and on race tracks, if the vehicle or its parts are modified or tampered with (even partially), in the event of improper repair and inadequate maintenance or if the chassis identification numbers are modified or removed.

Defects and damage caused by force majeure, chance and weather conditions (hail, sunlight, rain, etc.) are also excluded from the warranty.

The warranty is transferable in the event of resale between private individuals. Please note that the new customer must notify AureusDrive of the transfer of the warranty within 14 days of purchase, stating the frame number and their contact details (first name, surname, address, telephone number), as well as the details of the previous owner, by emailing info@aureusdrive.ch.

3 WARRANTY CONDITIONS

Warranty period

AureusDrive guarantees 5 years on frame damage caused by production defects and 2 years on all other components from the date of delivery ex works / collection ex works. For the battery, AureusDrive guarantees at least 70% capacity after 2 years.

Warranty services

Under this warranty, AureusDrive agrees to repair all defects in materials and workmanship that occur under normal operating conditions. The warranty covers the repair or replacement of defective parts as well as the labor costs required to perform the repairs.

Warranty claims

In order to claim warranty services, the vehicle owner must contact the nearest AureusDrive workshop / authorized AureusDrive partner and present the vehicle together with the proof of purchase or this warranty booklet.

AureusDrive reserves the right to reject warranty claims if the damage is not covered by the warranty provisions.

4 EXCLUSION OF LIABILITY

The condition for claiming is punctual compliance with the vehicle-specific maintenance program at AureusDrive or an authorized workshop partner.

The warranty does not cover damage caused by improper handling / transport / care & cleaning, negligence, accidents, modifications to the vehicle without the consent of AureusDrive, subsequent conversion / installation of non-compatible or non-original parts, improper maintenance or unauthorized repairs.

Normal wear and tear (wearing parts – see definition of wearing parts) and ageing, as well as damage caused by external influences such as weather conditions, water or improper use, are also excluded from the warranty.

It is the buyer’s responsibility to regularly service and maintain the vehicle purchased (see mandatory inspections).

AureusDrive is not liable for direct or indirect damage or consequential damage resulting from the use or inability to use the vehicle, even if this damage was caused by warranty work.

Definition of wear parts

The following parts are considered wear parts and are excluded from this warranty:

Bumpers in forks and dampers, coatings on fork stanchions and damper pistons, moving rubber parts, brake pads, brake discs, torque sensors, seals, suspension forks, springs, rim flanks/brake surfaces, freewheel bodies, slide rings and bushes, grips and handlebar tape, cassettes, sprockets, chainrings, chains, chain guides, bearings and bearing seats, air seals/o-rings, tires, shift lever rubber linings, shift components, foam parts, mudguards, chain guides, cables and outer covers, spokes, dust rings. 5 GENERAL PROVISIONS

These warranty conditions constitute the entire agreement between the vehicle owner and AureusDrive.

Amendments or additions to these warranty conditions require the written consent of AureusDrive.
